Employment (Amendment) Act 2012
This circular is to inform members of the coming into force of the Employment (Amendment) Act 2012, amendment to the First Schedule to the Employment Act 1955 and the exemption order relating to the application of ‘contractor for labour’ as defined in section 2 of the Act.
In exercise of the powers conferred by subsection 2(2) of the Employment Act 1955 [Act 265], the Minister of Human Resources by gazette notification P.U.(A) 88 dated 30 March 2012, has amended in item 1 under the heading “Employee” by substituting the words “one thousand five hundred” the words “two thousand”. By virtue of the above Order which took effect from 1 April 2012 the term “Employee” now includes any person whose wages do not exceed two thousand ringgit a month. Paragraphs 2 and 3 of the First Schedule remain unchanged.

From Oct 1, 2010, employers who hire part-time employees will be required by law to make EPF and SOCSO contributions for their workers. Part time worker will be able to enjoy better benefits such as Employee Provident Fund, SOCSO and Medical coverage on pro rate basis.
This new regulation takes effective on 1 Oct 2010. Employers must contribute EPF & SOCSO as long as the part timer work between 30% and 70% of the number of hours clocked in by regular staff. This means that if a regular employee puts in eight hours a day, those who put in between 2.5 hours and 5.5 hours qualify as part-time employees.
The number of hours can also be accumulated over several days in a week as long as the arrangement is agreeable to both parties.
